FNCCI special general meeting today

Kathmandu, october 20,2016: The special general meeting of the Federation of Nepalese Chambers of Commerce and Industry (FNCCI) will be held tomorrow as per schedule, since the Patan High Court today refused to issue an interim order on the writ filed by former senior vice president of the organisation Bhaskar Raj Rajkarnikar and his aide Govinda Prasad Ghimire.

The bench of Chief Judge of Patan High Court Tanka Moktan and Judge Dilli Raj Acharya refused to issue an interim order to stop the special general meeting as sought by the plaintiffs Rajkarnikar and Ghimire.

Rajkarnikar and Ghimire had filed a writ at the Patan High Court citing the special general meeting called by the FNCCI executive committee breached the provision of the FNCCI statute.

However, the court after hearing the arguments presented by the plaintiffs and defendant today refused to issue an interim order citing the defendant  FNCCI  had given prior notice to the members and is abiding by all the process as per its statute to hold the special general meeting.

On Tuesday, the court had summoned both the plaintiff and defendant today to determine whether or not the interim order was required.

After the court’s clearance on the matter, FNCCI has made all the preparations to hold the special general meeting, which requires at least 50 per cent of its members to be present to meet the quorum.

While annual general meetings require only 40 per cent of the members to be present to fulfil the quorum, a minimum of 50 per cent members need to be present for validity of special general meetings,” explained Pashupati Murarka, president of FNCCI.

FNCCI had called a special general meeting on July 14 for the purpose of amending its statute to approve changing the organisational structure in line with the federal structure provisioned by the new constitution of the country.

Similarly, the executive committee has also proposed that the senior vice president will automatically be appointed as the president of the organisation, which means there will not be an election for the top post of the organisation.

As per the provision of the existing statute of FNCCI, a senior vice president is elected from the executive committee and all the remaining posts through direct election. But as per the proposed amendment of the FNCCI statute, there will be direct election for all posts, including senior vice president, except president.

“If the proposed amendment is endorsed from the special general meeting, the senior vice president of the organisation will be the president in the next term,” according to Murarka.

Similarly, as per the provincial structure of the FNCCI also included in the proposed amendment, there will be provincial president in each proposed seven provinces starting next election of the largest private sector umbrella body, which is going to be held in mid-April, 2017.

The delegates of the special general meeting will decide whether to amend the statute as proposed or not. If differences arise, there will be voting on each section of the proposed amendment, according to Murarka.

“If the statute is amended from the special general meeting, it will come into effect from the date of amendment.”

Ex-presidents boycott

KATHMANDU: Six former presidents of Federation of Nepalese Chambers of Commerce and Industry (FNCCI) have announced they will not be attending the special general meeting scheduled to be held on Thursday citing despite being widely reported in the media, they have not received an invitation for the event.

The letter addressed to FNCCI President Pashupati Murarka, a copy of which was obtained by The Himalayan Times, states the former presidents have never been consulted for amendment of the statute of the largest umbrella body of the private sector in the country.

The signatories of the letter include former FNCCI presidents Mahesh Lal Pradhan, Padma Jyoti, Anandraj Mulmi, Pradeep Kumar Shrestha, Binod Bahadur Shrestha and Kush Kumar Joshi.
